These Terms govern your purchase and use of The 9PM Files. By placing an order you agree to them. Please read section 3 — it is the part people are most often surprised by.
1. Who you are buying from
The 9PM Files is operated by DEMURTAS AGENCY S.R.L., a company registered in Romania, registration number J2024001952403, registered office Str. Gabroveni nr. 61, Camera 1, Birou 54, Bl. Y1A, Sc. C, Et. 3, Ap. 9, Sector 3, 030087 Bucharest, Romania, VAT status registered for VAT in Romania under number RO49650596. Contact: hello@9pmfiles.com.
In these Terms, "we" and "us" mean that company; "you" means the person placing the order.
2. What we sell
We sell digital case files: sets of fictional documents you read and solve, one case at a time. Every product on this site is delivered as files. Nothing is manufactured, packaged, or posted to you.
All persons, companies, addresses, agencies, case numbers and events in our products are fictional. Any resemblance to real people, living or dead, or to real investigations, is coincidental and unintended.
3. Nothing ships
You are buying a download. No physical item will arrive. You do not need a printer: the files can be read on a phone, tablet or computer. Printing is optional.
If you expected a boxed product, do not place the order — and if you already have, section 8 applies and we will refund you.
4. Delivery
After payment you receive an email with two links, normally within a few minutes. One is yours. The other one you send to whoever is playing with you. The case opens in a browser, so there is nothing to download, unzip or install. The links do not expire. If the email does not arrive, check spam and then write to hello@9pmfiles.com and we will send them again.
5. Your licence — what you may and may not do
When you buy a case, we grant you a personal, non-exclusive, non-transferable licence to download, store, print and play it. You do not acquire ownership of the underlying work.
You may:
- print as many copies as you need for your own play;
- play it with friends and family in a private setting;
- keep the files indefinitely.
You may not:
- resell, sublicense, rent, or give away the files or your download links;
- upload them to any file-sharing service, cloud folder, or public website;
- use them in a commercial setting — a paid event, a bar, an escape room, a school course sold for a fee — without a commercial licence from us;
- modify them and present the result as your own, or remove our notices.
If you want to run a paid event, write to hello@9pmfiles.com. We will say yes more often than you expect.
6. Intellectual property
All text, documents, layouts, audio, images and the case structure are our property or licensed to us, and are protected by copyright. The licence in section 5 is the only right you receive.
7. Price, currency and tax
Prices are shown in US dollars and are the amount charged. Where sales tax, VAT or an equivalent applies to a digital sale in your location, it is handled as indicated at checkout. You are responsible for any charge your own bank applies for a foreign transaction.
8. Refunds
We do not offer a general money back guarantee, because the case is delivered immediately and in full. Our position is set out on the Refunds page and forms part of these Terms. If something is wrong on our side, a link that will not open, a page that will not load, an order charged twice, write to refunds@9pmfiles.com with your order number and we will fix it or refund you.
You keep the files. A download cannot be returned and we will not pretend otherwise.
Nothing in this section removes any right the law gives you as a consumer, including a right of withdrawal where one applies to you. If you believe you have one, write to us and we will honour it.
9. Age
Our products are written for adults and older teenagers. They deal with a fictional death in the form of paperwork: there is no gore and no graphic violence. We ask that purchasers be 18 or over, and that players be 14 or over.
10. What we do not promise
We provide the files as they are. We do not promise that you will solve the case, that any particular device will display the files a particular way, or that the site will be available without interruption.
Nothing in these Terms limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you for any claim connected with a purchase is limited to the amount you paid for it.
11. If something goes wrong
Write to hello@9pmfiles.com first. Almost everything is settled in one email, and we would rather refund you than argue with you.
These Terms are governed by the laws of Romania, and the courts of Bucharest, Romania have jurisdiction — except where the law of your country of residence as a consumer gives you the right to bring proceedings elsewhere, which it may, and which we do not attempt to take away.
12. Changes
We may update these Terms. The version that applies to your order is the one published when you placed it.
